Welcome to Msendo! By using our e-hailing application, you agree to the following terms and conditions. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, and/or using the Msendo app, you agree to be bound by these terms and conditions (“Terms”). If you do not agree to these Terms, please do not use the Msendo app.

2. Definitions

• “Msendo,” “we,” “us,” or “our” refers to the Msendo e-hailing service.
• “User,” “you,” or “your” refers to any individual who downloads, installs, or uses the Msendo app.
• “Driver” refers to the individuals who provide transportation services through the Msendo app.
• “Passenger” refers to the individuals who request and receive transportation services through the Msendo app.

3. Use of the Msendo App

3.1 Eligibility: You must be at least 18 years old to use the Msendo app. By using the app, you represent and warrant that you have the right, authority, and capacity to enter into and abide by these Terms.

3.2 User Account: To use the Msendo app, you must create an account. You agree to provide accurate and complete information during the registration process and to keep this information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 License: Msendo grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes, subject to these Terms.

4. Services

4.1 E-Hailing Services: Msendo provides a platform that connects Passengers with Drivers. The transportation services provided by Drivers are the responsibility of the Drivers. Msendo acts as an intermediary to facilitate the provision of these services.

4.2 Booking and Payment: Passengers can book rides through the Msendo app. The fare for each ride will be calculated based on the distance traveled and other factors. Payment will be processed through the app using the payment method provided by the Passenger.

4.3 Cancellation Policy: Passengers may cancel a ride request at any time before the Driver arrives at the pickup location. A cancellation fee may apply if a ride is canceled after a Driver has accepted the request.

5. User Conduct

5.1 Prohibited Activities: You agree not to:

• Use the Msendo app for any unlawful purpose.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Msendo app or servers or networks connected to the app.
• Engage in any conduct that could damage, disable, overburden, or impair the Msendo app.

5.2 Driver Conduct: Drivers agree to:

• Provide safe and professional transportation services.
• Comply with all applicable laws and regulations.
• Maintain appropriate insurance coverage as required by law.

6. Disclaimers and Limitation of Liability

6.1 Disclaimers: Msendo provides the app and services on an “as is” and “as available” basis. We do not warrant that the app will be uninterrupted or error-free. To the fullest extent permitted by law, Msendo disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

6.2 Limitation of Liability: To the fullest extent permitted by law, Msendo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the app; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the app; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our app by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the app.

7. Indemnification

You agree to indemnify, defend, and hold harmless Msendo, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with (i) your access to or use of the app; (ii) your violation of these Terms; (iii) your violation of any law or the rights of a third party; or (iv) your interaction with any Driver or Passenger.

8. Termination

Msendo may terminate or suspend your account and access to the app at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the app will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nigeria without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Nigeria

10. Changes to These Terms

Msendo reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least [30 days] notice prior to any new terms taking effect. Your continued use of the app after the changes become effective constitutes acceptance of the new Terms.
